1 Appellant, Darrell Tucker, hereinafter referred to as defendant, was charged with murder in the District Court of Pittsburg County, Case No. CRF 70-131. Defendant was found guilty of manslaughter in the first degree by jury verdict, with punishment fixed at ten (10) years imprisonment. Judgment and sentence was imposed on October 2, 1970, and this appeal perfected therefrom.
